Welcome to Last Human! The terms “we”, “us” and “our” refer to Last Human (operated by FKAHUMANS PRIVATE LIMITED). Last Human operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Last Human is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

1. ACCESS AND ACCOUNT
You confirm you are at least 18 years old (age of majority in India) and have authority to allow minor dependents to use devices you own or manage.
You may need to provide information (email, billing, payment, shipping). You warrant such information is true, accurate, current, and complete and that you have the right to provide it.
You are responsible for safeguarding your account credentials and all activity under your account. You may not sell, assign, or transfer your account.
2. OUR PRODUCTS
We strive to display products accurately; colors/appearance may vary due to device settings. We do not warrant that products will meet every expectation or perfectly match on-screen renderings.
Descriptions, pricing, and availability may change at any time without notice. We may limit quantities to any person or region.
3. ORDERS
Placing an order is an offer to purchase. We may accept or decline any order at our discretion. An order is accepted when we confirm it (and for prepaid, after we receive payment).
Please review your order before submitting; cancellation may be unavailable after acceptance. If we decline, modify, or cancel, we will attempt to notify you at your provided contact details.
Purchases are subject to our Return/Exchange/Refund Policy.
You represent that purchases are for personal/household use, not for resale or export.
4. PRICES, TAXES, AND BILLING
Prices, discounts, and promotions may change without notice. The price charged is the price at checkout and in your confirmation email. Unless expressly stated, prices are inclusive of GST and exclude shipping/handling or import duties (if any).
You agree to provide current, complete, and accurate purchase and payment information, and to update it as needed to complete your transactions.
By paying, you warrant that (i) payment details are correct, (ii) you are authorized to use the method, and (iii) charges will be honored. You agree to pay all charges in INR, including applicable GST and shipping/handling.
Payment Methods & Processors: UPI, cards, net banking, wallets, EMI (as enabled), and COD (Cash on Delivery) where offered. We primarily use Razorpay and may additionally use PayU and Cashfree.
5. SHIPPING AND DELIVERY
Forward (original) shipping is free unless stated otherwise at checkout. Delivery timelines shown are indicative and not guaranteed.
Risk and title pass to you upon delivery to your address. If a parcel is delayed or appears lost before delivery, we will coordinate with the carrier to resolve it.
For returns or cancellations, shipping deductions/charges may apply as set out in our Shipping & Delivery Policy and Return/Exchange/Refund Policy.
For COD (Cash on Delivery) shipments, additional carrier handling rules may apply.
6. INTELLECTUAL PROPERTY
All content on the Services—text, graphics, images, logos, video, audio, and their arrangement—is owned by FKAHUMANS PRIVATE LIMITED or its licensors and protected by Indian and international IP laws.
Use is limited to personal, non-commercial purposes. No license is granted except as expressly stated.
Our marks (including “LAST HUMAN” and related logos) are proprietary. Trademark application for “LAST HUMAN” wordmark has been filed; pending grant, all rights are reserved. Shopify and other marks are the property of their respective owners.
7. OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. Your use is at your own risk and subject to third-party terms. New features/tools will also be governed by these Terms.
8. THIRD-PARTY LINKS
Third-party links/materials are provided for convenience. We are not responsible for their content or practices. Review third-party terms and policies before use or purchase.
9. RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify. All sales are between you and FKAHUMANS PRIVATE LIMITED (Last Human), not Shopify. You agree Shopify is not responsible for purchases made from us and you release Shopify from related claims.
10. PRIVACY AND DATA PROTECTION (INDIA)
Your personal information is processed per our Privacy Policy and by Shopify under its privacy policy for hosting and platform services.
We comply with applicable Indian data laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act) and relevant IT rules. By using the Services, you consent to processing, including transfers to service providers (e.g., Shopify, Razorpay, PayU, Cashfree) which may be outside India, for providing and improving the Services.
For privacy and consumer complaints, contact our Grievance Officer (details in Section 24). We acknowledge within 48 hours and aim to resolve within 30 days.
11. FEEDBACK AND REVIEWS
If you submit ideas, suggestions, reviews, photos, or other content (“Feedback”), you grant us a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such Feedback to operate and improve the Services.
You represent you have the necessary rights, you will disclose any incentives, and your Feedback complies with law and these Terms.
We may (but are not obligated to) moderate Feedback and may choose whether to display it. We may remove or decline to publish content that is unlawful, misleading, infringing, obscene, abusive, incentivized without disclosure, or otherwise violates policy/law. We do not post fake reviews. You are responsible for your Feedback.
12. ERRORS, INACCURACIES, AND OMISSIONS
Information may contain typographical errors or inaccuracies (including pricing, availability, shipping charges, or transit times). We may correct/update such information or cancel orders affected by errors at any time, including after submission.
13. PROHIBITED USES
You agree to use the Services lawfully and not to: violate laws; infringe IP; harass or harm others; transmit malware; engage in fraud, scraping, spam, or security circumvention; or otherwise interfere with the Services. We may suspend or terminate access for violations.
14. TERMINATION
We may suspend or terminate your access at any time. You remain liable for amounts due up to the date of termination. Sections intended to survive (e.g., IP, Feedback, Limitations, Governing Law) continue to apply.
15. DISCLAIMER OF WARRANTIES
Except as required by law or expressly stated by us, the Services and all products are provided “as is” and “as available” without warranties, express or implied (including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted or error-free operation). Your statutory consumer rights under Indian law remain unaffected.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by Indian law, we (and our directors, employees, agents, and service providers) are not liable for indirect, incidental, special, punitive, or consequential losses (including lost profits, data, or goodwill) arising from the Services or products.
Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law. Your exclusive remedy for dissatisfaction is to stop using the Services and, where applicable, seek a refund per our policies.
17. INDEMNIFICATION
You agree to indemnify and hold harmless FKAHUMANS PRIVATE LIMITED (Last Human) and our affiliates, officers, employees, agents, and providers from claims, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.
18. SEVERABILITY
If any provision is held unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will continue in full force.
19. WAIVER; ENTIRE AGREEMENT
Our failure to enforce a right is not a waiver. These Terms and linked policies form the entire agreement between you and us and supersede prior understandings regarding the Services.
20. ASSIGNMENT
You may not assign your rights/obligations without our written consent. We may assign or transfer our rights/obligations without notice.
21. GOVERNING LAW AND JURISDICTION (INDIA)
These Terms are governed by the laws of India. The courts at Jammu, India shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms and the Services.
22. HEADINGS
Headings are for convenience only and do not affect interpretation.
23. CHANGES TO TERMS
You can review the current Terms on this page. We may update the Terms by posting a revised version with an effective date. Where required by law, we will provide notice of material changes. Your continued use after the effective date constitutes acceptance.
